The photos showed a dream villa, but the reality is very different: a green pool, mould on the walls, pests or a faulty heating system during a winter break. If your booked holiday house or holiday flat has significant defects, your rights will usually arise under your accommodation contract, the UK Consumer Rights Act 2015 and, where applicable, the Package Travel and Linked Travel Arrangements Regulations 2018.
The law is on your side here: if the accommodation does not match the promised description, you may be entitled to a price reduction. The biggest mistake: travellers put up with the problem for two weeks, go home and only then ask the portal for money back. That usually does not work. The Becker family books a finca in Mallorca for €2,500. The pool, advertised as a key feature, is completely dirty on arrival and the pump is broken. Despite immediate reporting to the agency, nothing happens for days.
Outcome: The loss of a promised key facility such as a swimming pool may justify a 15% to 20% reduction for the period of the defect, depending on the circumstances and with reference to industry-standard ABTA guidelines for compensation.
A married couple rents a cabin in Denmark in December. The heating fails completely on the second day and the indoor temperature drops to 12 degrees. The caretaker cannot be reached.
Outcome: A total heating failure in winter is a serious defect. If the property is practically uninhabitable, the provider may face up to a 100% reduction for the affected days. The guests may even move to a hotel and claim the additional costs.
