Example 1: Pests and mould in the room

The Smith family books a 14-day holiday in Crete. The room has significant mould in the bathroom, and there are also cockroaches. Despite reporting it immediately, no replacement room is provided.
Outcome: Under industry-standard ABTA guidelines for compensation, mould and a serious pest problem are substantial defects. A reduction in the holiday price of 10% to 50% (depending on severity) may be recoverable.

Example 2: Building noise by the hotel pool

Mr Smith books a wellness hotel in Turkey. On arrival, the pool area is being renovated with pneumatic drills. Any chance of relaxation is gone. The tour representative is informed immediately.
Outcome: Noise disturbance caused by building works in the hotel area will generally justify a price reduction of 10% to 40%, depending on the duration and intensity of the noise during the main holiday period.

Who do I need to report the hotel problem to?
If you booked a package holiday, you must report the problem immediately to the tour operator’s local representative. A complaint made only to the hotel reception is often not enough. Under the Package Travel and Linked Travel Arrangements Regulations 2018, you can also notify the travel agent or booking platform, which must pass the complaint on to the organiser.
What are the ABTA compensation guidelines?
The ABTA compensation guidelines are an industry-standard reference often used when calculating price reductions for holiday defects. They provide percentage-based indications, for example 10–20% for the absence of an advertised sea view, up to 15% for repetitive food, or up to 50% for a serious pest infestation.
What time limits apply when making a claim for holiday defects?
The legal limitation period for claims arising from a package travel contract is generally up to six years in England and Wales, and five years in Scotland, depending on the nature of the claim. However, it is strongly recommended that you submit your claim in writing to the organiser as soon as possible after returning, while the evidence is still fresh.
Can I claim a price reduction for hotels booked individually?
Yes, but the UK package travel rules will not usually apply. Instead, your rights will depend on the contract terms, the law governing the booking, and potentially the UK Consumer Rights Act 2015 where applicable. You would normally need to pursue the claim directly against the hotel, not the booking platform (such as Booking.com, as these are usually only intermediaries). In practice, enforcing claims abroad is often significantly more complicated.
