Example 1: Itinerary change & missed port

On a Mediterranean cruise (total price £3,000 for 10 days = £300/day), the highlight stop at Santorini is cancelled due to strong winds without an equivalent replacement port.
Outcome: As the holiday contract was not delivered as agreed, the ABTA compensation guidelines may support a price reduction. For the lost day, the passenger will often be entitled to around 20 to 30% of the daily price (around £60 - £90 per person).

The allocated cabin is directly below the ship’s nightclub. Sleeping is impossible until 3 am. Reception has no replacement cabin available.

FAQ: Your rights in detail

What amount is the percentage applied to?
The reduction is always calculated proportionately. If the defect affects the whole holiday (for example, a missing balcony that was booked), the reduction is based on the total holiday price. If the problem only occurs on certain days (for example, 2 days of construction noise by the pool), the holiday price is divided by the number of travel days and the percentage is applied to that daily holiday price.
What happens if the cruise line claims force majeure?
For a holiday price reduction, arguments about force majeure (such as storms or dense fog) will not necessarily prevent a claim where the holiday was not provided as booked. A reduction may still be due if the contracted service was not delivered, even where the cruise line was not at fault. The position may be different for additional damages for loss of enjoyment.
Can I demand an outside cabin if my inside cabin is defective?
Yes. If the booked cabin category cannot be used because of a defect and no identical cabin is available, the cruise line should offer a free upgrade where reasonable. If the cruise line refuses and you have to remain in the defective cabin, your claim for a price reduction may increase significantly.
