Cancelling a package holiday: your legal rights

As a consumer, you generally have the right to cancel a booked package holiday before the start of the trip. Under the Package Travel and Linked Travel Arrangements Regulations 2018, the organiser will usually lose its entitlement to the full holiday price once the contract is terminated. In return, however, it may charge an appropriate and justifiable termination fee or cancellation charge. How high that charge may lawfully be is a frequent source of dispute between travellers and travel companies.

Cancel free of charge in cases of unavoidable and extraordinary circumstances

The most important special case in package travel law is where unavoidable and extraordinary circumstances occur at the destination or in its immediate vicinity and significantly affect the performance of the package or the carriage of passengers to the destination. Classic examples include hurricanes, widespread wildfires, outbreaks of epidemics or acts of war. Official Foreign, Commonwealth & Development Office travel advice against travel is also a very strong indication. In these cases, no cancellation charges at all may be imposed on you. Challenge fixed cancellation charges in the terms and conditions

If you cancel for purely personal reasons (e.g. an unexpected illness without travel cancellation insurance, redundancy or simply lack of time), the terms and conditions of Leger Holidays will usually apply.

Under UK consumer law, cancellation terms must be fair and transparent, and package holiday organisers must be able to justify charges by reference to expected cost savings and possible alternative use of the travel services. You are entitled to challenge disproportionate charges and ask the organiser for a specific breakdown of the cancellation fee. The organiser should then explain in detail what costs it actually incurred because of your cancellation and, above all, what it saved (for example, hotel catering not provided) or whether it was able to resell your room or other travel services. In practice, organisers often struggle to evidence this in detail, which is why the actual cancellation charge may later be reduced significantly.

Frequently asked questions (FAQ) about cancelling a holiday

When must the organiser refund the holiday price?

Under the Package Travel and Linked Travel Arrangements Regulations 2018, where you are entitled to terminate due to unavoidable and extraordinary circumstances, or after lawful cancellation charges have been deducted, the organiser must refund the money without undue delay and in any event within 14 days of receiving the termination notice.

Does my travel cancellation insurance also apply if I am simply anxious about travelling?

No. Travel cancellation insurance only applies to contractually defined, unexpected events such as serious illness (a medical certificate is usually required), a serious accident, an unexpected pregnancy or sudden redundancy. Anxiety alone, for example about approaching severe weather at the destination, is not insured.

What is different when cancelling independently booked travel arrangements?

If you booked your flight and hotel separately from one another, package travel protections do not apply. For scheduled flights, unless you bought an expensive flexible fare, you will usually only get taxes and charges back. For hotels, the accommodation provider's own cancellation terms apply. When booking, look out for options such as "Free cancellation until day X".
